Basic $125 Separation Agreement


We bring over 30 years of experience in analyzing the division of property when a marriage is ending.  And, while each marriage is unique, having prepared hundreds of Separation Agreements through the years, we've developed a set of questions which quickly both add and take out options in your Agreement.  This allows us to move faster and create Agreements cheaper than our competitors while still providing you with a very high quality product, priced at a flat rate.


Below is an outline of the provisions of a 'Basic' $125 Agreement.   This is usually all you need for most Agreements when you have already divided or reached an agreement on how you will divide your marital properties.   The Basic Agreement includes most of the provisions most people separating need.


IF YOUR AGREEMENT IS DRAFTED PROPERLY IT ALLOWS YOU TO DO ANYTHING YOU COULD DO IF DIVORCED EXCEPT:  YOU MAY NOT MARRY AGAIN UNTIL A DIVORCE JUDGMENT IS ENTERED.


But some clients need a more Detailed Agreement.  Such a Detailed Agreement is more expensive but, again, we tailor very sophisticated options for your sharing time with children, dividing retirement accounts, selling a house in the coming months and/or dealing with more valuable specific items of personal property all for a flat rate usually less than $400.


So first we send you a series of questionnaires for you to answer.   Then, using this data, we create the 'shell' of your Agreement and narrow down what your Agreement needs so we can use our Phone Consultation time with you efficiently.   Agreements vary in degree of difficulty but we keep working on your Agreement until it sets out what you want.


Clicking 'Continue' below will begin a series of questions to help us determine what you really need your Separation Agreement to do.  Based upon your responses, we may send you links to additional questionnaires we have for various topics.  We will then set up a time to talk about your situation.  After this consultation we will provide you with a Flat Fee quote for an Agreement.  If you accept our 'Offer' we will begin work on your Agreement and continue on through as many drafts as necessary.  Once you are satisfied with your Agreement, then, and only then, will we accept your payment for your Agreement, and send you a Final version with signature lines and a short summary report you can use should have decide to incorporate the terms of your Agreement into a subsequent Divorce.


The 'Basic' Separation Agreement includes:

So there is no dispute about this date later.
Your spouse no longer automatically inherits your property if you die without a Last Will and Testament and voids inheritance provisions listing your spouse in an existing Will.
You may buy and sell property individually, without a claim by your spouse.
Allows for your children to live with one parent and stay with the other parent every other weekend - from the end of school to either the night before or the morning when school resumes - with an alternating division of Christmas Holidays and Summers.  Minor modifications of this arrangement are anticipated and included for the 'Basic' price.
Neither party shall support the other and each party shall provide for their own health and automobile insurance.
If Personal Property is NOT listed in the Agreement the property is deemed to be owned individually by the party in possession.  Specific pieces of personal property to be divided AFTER the signing of the Agreement may be listed for $2 each.
If you own a house together, the house will either: (a) Be listed for sale by a realtor within "X" days with the proceeds divided equally; or (b) One Party will buy out the Other Party within "X" days.
All retirement accounts shall remain the sole property of the person 'named' on the account.
Allows for a listing of two titled (2) Vehicles - Cars, Mobile Home, Boats, etc - with a writ of possession to each party along with an agreement for each party to carry individual insurance and an indemnification clause to the other party for failure to do so.
A Limited Power of Attorney (LPOA) authorizes you to act on behalf of your Spouse for a limited purpose, such as sell or trade a jointly titled automobile.  While your Separation Agreement usually divides 'possession' of your automobiles, often the 'ownership' of the vehicle will continue to be listed as 'Joint' until the debt is paid off or the car is sold/traded.  A LPOA will allow you to sell, trade or take sole ownership of the vehicle once the debt is paid without having to have your spouse sign the title.
Each Agreement comes with a Phone Consultation to review your situation.  Minor modifications agreed upon during the Phone Consultation are allowed for the $125 Basic Cost.
Once you are satisfied with the Final version of your Agreement, at that point we will send you instructions for the payment of the Legal Fee.  Once this fee is paid, a Signature Page for the Agreement is sent to you with processing instructions.  If additional changes are made after the Final version we charge $20 for each Final version thereafter.
Once you Approve the Basic Agreement, the Final Agreement will be sent to you by Email as a PDF attachment.  You must to be able to Print the Agreement.  There is a $20 additional charge if we must Mail you the Agreement.
